Indian-origin autistic man wins lawsuit, for being called Stupid March 30, 2017 10:27

An 30-year-old autistic man has sued a British health club chain for calling him ‘stupid’ in a case of disability. Indian-origin Ketan Aggarwal represented himself in court. Agarwal said that the coach yelled at him in front of the whole class when he, along with a friend suggested that the music was too slow, the incident occurred in May 2015. According to court documents, Aggarwal was yelled at in May 2015, in front of the whole class when he suggested that the music was too slow. The coach responded by saying that “don’t teach me how to do my job”. At the end of the class, the instructor called him stupid in front of everyone. Aggarwal decided that he would take the matter to the court on his own, after he realised that he could not get any help by complaining to the authorities. Aggarwal started preparing for the case by studying the various cases of discrimination in the library and on the internet and prepared a strong case against the multi-million pound company that is partly owned by Richard Branson’s Birgin Group. He fought the case successfully, representing himself as a victim of disability harassment. Aggarwal said, “Calling someone with a mental disability ‘stupid’ is similar to mocking a guy in a wheelchair. If I was that stupid I wouldn’t have been able to successfully pursue the claim against a solicitor of a billion pound company.” The health club then dismissed the instructor. As per the court’s orders Virgin Active paid Aggarwal USD 238 and USD 1,504 for costs and compensation, respectively. The court also ordered to issue a written apology and train its staff on equality. Indian-origin UK minister awarded Pravas Bharatiya Samman AMandeep

Six booked for duping NRI of over 30 million rupees March 30, 2017 10:20

Police have arrested six persons, including a revenue official and a woman for allegedly duping an NRI of over 30 million rupees under the grab of selling a piece of land to him, which did not exist. Harbajan Singh Jaspal, who is a UK based NRI said that particularly property dealers had done a deal of selling him a 20 kanal and 2 marla piece of land with him for Rs 18 million on May 18, 2015. The suspects reportedly said Jaspal that the land belonged to Rajwinder Singh, whose mother Shiv Dev Kaur has the power of attorney, police said. Jaspal gave 4.5 million rupees through different cheques as advance money, police said. Registry was due on September 9, 2015. The suspects demanded additional 4.6 million rupees, which he paid, but still the registry was incomplete. Meanwhile, an official from the revenue office appeared on the scene and assured that the NRI, if he agreed to buy the land at a high price of 20 million rupees (2 million more than the previously settled rate), then the official would ensure that the registry was done, police said. The NRI later came to know that the fees of stamp papers for the registry were only 2 million rupees and the officials had defrauded him of 5.2 million in this too. Later, Jaspal realized that he was taken for a ride as the land did not exist at all and the piece that the accused had shown him was actually a road, police said. A case under Sections 420 (cheating and dishonestly inducing delivery of property), 465 (forgery) 467 (forgery of a valuable security, will), 468 (forgery for purpose of cheating), 471 (using as genuine a forged document) and 120-B (criminal conspiracy) of IPC was registered against the accused, they added NRIs Not Eligible for Aadhaar Card AMandeep

India, Israel share similar culture March 30, 2017 09:25

Indian-origin United States Ambassador to the UN, Nikki Haley said that the Indian and Israeli cultures share “many similarities” and people of both the nations believe in professionalism and rarely “back down from a fight.” While there are many "good things" about the people of the two countries, they are also "aggressive" and "stubborn", she said. In her address to American Israel Public Affairs Committee Policy Conference she said that, “she is the daughter of Indian parents, who reminded her brothers, her sisters and her everyday that, how blessed they were to live in this country. “The truth is, I have seen so many similarities between the Israeli culture and the Indian culture." In response to a question Haley said “We are very close knit. We love our families. We have a strong work ethic. We believe in professionalism and philanthropy, and giving back. So that's all the good things. We're aggressive. We're stubborn. And we do not back down from a fight." She also ruled that the Iranian deal had only empowered the Iranians. "It's concerning. And the reason it's concerning, is because when the Iran deal took place, all it did was empower Iran, and it empowered Russia. And it emboldened Iran to feel like they could get away with more," she said. "It is - you can put sanctions on a country. To take sanctions away, it's very hard to go back and put sanctions back on. So what we have said is, we're going to watch them like a hawk. We're going to make sure that every single thing they do is watch, processed and dealt with," she said. She said that the United States will not take its number one democratic friend in the Middle East to tackle the threats to peace and security. "I think what you're seeing is they're all backing up a little bit. The Israel-bashing is not as loud. They didn't know exactly what I meant outside of giving the speech, so we showed them. So when they decided to try and put a Palestinian in one of the highest positions that had ever been given at the UN, we said no and we had him booted out," she said. NRIs not eligible for Aadhaar Card March 30, 2017 07:53

Millions of NRIs living across the world need not bother about their Aadhaar identity card, as it is not applicable to them, a top Indian official said. CEO of Unique Identification Authority of India, Dr. Ajay Bhushan Pandey said that “According to Aadhaar Act, only residents of India are entitled to get an Aadhaar number. Non Residential Indians cannot get an Aadhaar because they are not entitled to get it.” The Unique Identification Authority is responsible for the enrollment process and authentication of data for India’s unique identification system, Aadhaar and maintaining the nation’s Central Identities Data Repository. According to Section 3.1 of Aadhaar Act 2016, only a resident of India shall be entitled to obtain an Aadhaar number. The act does not specifically and explicitly exempt NRIs from the enrollment, as Dr. Pandey was referring to the fact that an Indian would be considered as an NRI, if the person did not stay for at least 182 days in India in the preceding year as per other relevant laws, including the Income Tax Act. As government orders never specifically exempted NRIs from Aadhaar enrollment, there was a rumor that NRIs also had to get the card. Several Indian expatriates expressed their concerns about the latest move by the Indian government to make Aadhaar card mandatory for accessing several services and transactions. Dr. Pandey explained that the authority was not supposed to issue Aadhaar card to NRIs. “NRIs cannot get an Aadhaar card.” While applying for an Aadhaar card, Indians have to make a declaration in the application stating that they are a resident of India. The declaration reads: “I confirm that I have been residing in India for at least 182 days in the preceding 12 months.” However, when it was pointed out that NRIs have already obtained the unique identity card, Dr Pandey said: “The legal position is that they were not supposed to apply for the card. They have given a declaration that they have stayed in India for 182 days. Dr. Pandey said that he was not sure, if Indian expatriates would face any legal action for “illegally obtaining the card”. But technically there is a violation; they should not have taken it,” he added. “I will have to see in what circumstances NRIs obtained the card,” when asked if the authority would initiate any legal action. NRIs, who have obtained the Aadhaar card cannot cancel it as, there is no provision to cancel Aadhaar card. “Once generated, Aadhaar number will exist forever,” Dr. Pandey said. Dr. Pandey made it clear that NRIs need not worry about access being denied to government services for not having an Aadhaar card. It is the responsibility of the relevant departments to give exemption to NRIs in this regard, he added. Indian-origin South African anti-apartheid activist passes away AMandeep

Ahmed Kathrada an Indian-origin South African anti-apartheid activist, who was one of Nelson Mandela’s closest aides, passed away on Tuesday at a hospital in Johannesburg at the age of 87. He died after a short illness following brain surgery. Kathrada was among those activists, who were jailed alongside Mandela in the Rivonia trail in 1964 that drew worldwide attention and highlighted the brutal legal system under the apartheid regime. He spent 26 years and three months in jail, 18 of which were spent on Robben Island After the end of the apartheid regime, he served as a parliamentary counselor from 1994 to 1999 to President Mandela in the first African National Congress ANC government. "This is a great loss to the ANC, the broader liberation movement and South Africa as a whole," Neeshan Balton, head of the Ahmed Kathrada Foundation, said in a statement. "'Kathy' was an inspiration to millions in different parts of the world." His activism against the white-minority apartheid regime started at the age of 17, when he was one of 2,000 "passive resisters" arrested in 1946 for defying laws that discriminated against Indian South Africans. The African National Congress was banned in 1960, and two years later Kathrada was held under “house arrest”. Later, he went underground to continue the struggle as a member of the ANC’s armed wing, Umkhonto we Sizwe (MK). On July 1963, Kathrada and other senior activists were arrested during a secret meeting at Liliesleaf Farm in Rivonia, a Johannesburg suburb. At the famous Rivonia trial, eight of the accused were sentenced to life imprisonment with hard labor on Robben Island. His fellow prisoners included Nelson Mandela, Walter Sisulu and Denis Goldberg. Derek Hanekom, a fellow veteran activist and now a government minister, said that he had lost a "revolutionary mentor and dear friend". "Comrade Kathy was a gentle, humane and humble soul. He was a determined revolutionary who gave his entire life to the liberation struggle in our country," Hanekom said. Kathrada was a moral figurehead of the anti-apartheid movement, said fellow Robben Island prisoner Laloo "Isu" Chiba "He has been my strength in prison, my guide in political life and my pillar of strength in the most difficult moments of my life. Now he is gone," Chiba, 89, said in a statement from the foundation. Kathrada obtained four university degrees, while he was in prison. He will be buried, according to the Islamic religious rights. House To Make Changes To Florida Recess Bill March 28, 2017 12:37

The changes to a bill making its way through the Florida house and senate could leave some "recess moms" unhappy. When the bill is submitted, the bill aimed to require all the public schools in Florida, grades k-5, to provide a 100 minutes of recess time per week. On an average it is about 20 minutes a day. Quitoria Combs and also her two-year-old son love to get outdoors and she said that having free time is important. "There's a lot of obesity and things like that going on. You want them to have that type of activity," said Combs. The recess bill has gone through the senate smoothly, but Chris Latvala a house representative out of the Clearwater, wants to amend the bill allowing personal education to count towards the recess requirements. It would extend the requirements to 150 minutes per week, but free play could only count for the kids in grades K-3. The amended bill would call for the 20 minutes of free play on days when personal education is not scheduled."With physical education, they have things that they have to do as far as, with the school board and things they have to teach the kids at that time," said Combs. After London Attack, South Florida Students Return Home Juliet Reyes said that her son Lucian has a speech delay and also getting outside with other children helps him learn how to interact with other kids. "I think it's going to be great for children and also for parents because they will have free time outside and I think it will teach the child that there are other ways to learn," said Reyes. "I think it's going to be great also for teachers so they can have a little break too." The bill needs to make its way through the committees before heading to the house floor for a vote and also will need to match the senate bill. If not, the senate and also the house will have to come to an agreement or nix the bill altogether. Mrudula Duddempudi.
